General Terms & Conditions
1. Applicability
1.1. The following general terms and conditions apply to all sales contracts made via the online shop of Marraine Kids GmbH on the website www.marrainekids.com between the seller, Marraine Kids GmbH, Kirchenseite 2, 4761 Rocherath (hereinafter also referred to as "we") and the purchaser of goods (hereinafter also referred to as "you") come about.
1.2. Goods within the meaning of these terms and conditions are all products and services that can be purchased as part of an online order in the Marraine Kids online shop.
2. Conclusion of the contract
2.1. Our product presentation in the Marraine Kids Online Shop does not constitute a binding offer to conclude a purchase contract.
2.2. Only adults with unlimited legal capacity are allowed to order. We only sell our goods to end users in commercial quantities.
2.3. With your order - by clicking the "Buy now" button - you are making a binding offer to purchase. We will send you an automatic confirmation of receipt by email, which documents your order again. This automatic confirmation of receipt only confirms that your order has been received by Marraine Kids GmbH and does not constitute acceptance of your offer.
2.4. The contract with Marraine Kids GmbH is only concluded when we confirm the dispatch of the goods to you by separate email. The acceptance period is a maximum of 7 calendar days.
2.5. The decision as to whether we accept an order is at our absolute discretion. If we cannot accept an order for any reason, we will inform you immediately; In such a case, payments already made by you will be reimbursed by us.
3. Statutory cancellation policy
3.1. Right of withdrawal
You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the last goods.
You can exercise your revocation by informing us of your decision to revoke this contract by means of a clear declaration (e.g. a letter sent by post or e-mail). You can use the attached model withdrawal form for this purpose, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period has expired.
3.2. Consequences of cancellation
If you withdraw from this contract, we will have all payments that we have received from you, including delivery costs (with the exception of costs that result from choosing a different type of delivery than the cheapest standard delivery offered by us ), to be repaid immediately and at the latest fourteen days from the day on which we received notification of your cancellation of this contract or the item. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; In no case will you be charged any fees for this repayment.
We can refuse repayment until we have received the goods back or until you have provided evidence that you have sent back the goods, whichever is earlier.
You must return or hand over the goods to us immediately and in any case no later than fourteen days from the date on which you informed us of the cancellation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired. We bear the costs of returning the goods.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to check the nature, properties and functionality of the goods.
4. Prices / shipping costs
4.1. The prices at the time of the order apply.
4.2. All prices stated in the Marraine Kids online shop are retail prices and include VAT and do not include shipping costs.

5. Terms of payment / means of payment
5.1. The goods can be paid for in accordance with the payment methods suggested in the ordering process and under the conditions specified there.
5.2. If you are in default of payment, we reserve the right to charge you a flat-rate reminder fee of EUR 5.99 for the second and all subsequent reminders, regardless of whether the first reminder was sent to you by post or email approached. You are allowed to prove that the damage we incurred is less than the flat fee. In the event of default in payment, you undertake to reimburse all costs, expenses and cash outlays that we incur in pursuing our claims. This includes, without prejudice to an obligation to reimburse costs under procedural law, also all extrajudicial costs of a commissioned debt collection agency or lawyer.
5.3. The customer can only exercise a right of retention if his counterclaim is based on the same contractual relationship.
6. Retention of Title
The goods remain our property until full payment.
7. Transport damage
If goods are delivered with obvious transport damage, please report such errors to the deliverer as soon as possible and please contact us immediately. Failure to file a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to assert our own claims against the carrier or the transport insurance.
8. Dispute Resolution
According to the EU regulation on online dispute resolution in consumer affairs (ODR regulation), consumer disputes can be entered at http://ec.europa.eu/consumer/odr .
We are ready to take part in an out-of-court arbitration procedure before a consumer arbitration board.
9. Copyright
The content and structure of the Marraine Kids online shop are protected by copyright. All texts, images, graphics, sound, video and animation files are subject to copyright, trademark law and other laws for the protection of intellectual property. Some Internet pages also contain images, graphics, sound, video and animation files that are subject to copyright, trademark law and other laws protecting the intellectual property of those who made them available. A copy or other use for other than private purposes or for passing on, other publication, duplication and distribution, whether in original or modified form and in any medium, or such use on other websites is without the prior express written consent of Marraie Kids GmbH not permitted.

11. Final provision
The law of the Kingdom of Belgium applies. The provisions of the United Nations Convention on Contracts for the International Sale of Goods (UN Sales Law) do not apply.
